We succesfully registered a 15-metre sailing yacht under the Cyprus flag, with EU customs/VAT status aligned to allow hassle-free cruising. The process covered ownership structuring, provisional registration, radio licensing and Union status proofs — managed end-to-end.

This ensured 0% dividend/interest withholding tax for the holding vehicle. Which is relevant for future charter income planning.
The Opportunity
Our client is a non-EU resident who wanted the yacht to sail under an EU flag. Cyprus offers a practical solution, but success depends on understanding two key elements.
1. Registration requirement: more than 50% of the ownership of the vessel must belong to EU or Cyprus entities. Here, this requirement is met through a Cyprus company,
2. Two-stage registration: the process begins with a provisional registration, which quickly grants the right to sail under the Cyprus flag. This must then be followed by permanent registration within six months (with the option of extension to nine).
The client also needed clarity on the yacht’s EU customs status — whether it should sail under Union status (evidenced by a customs document such as T2L or PoUS), or under Temporary Admission (allowing sailing in EU waters for 18 months).
The Solution
1. Ownership and Eligibility
A Cyprus private company limited by shares was incorporated to satisfy the EU requirement that more than 50% of the vessel’s ownership must be held by EU or Cyprus entities. The non-EU owner was then recorded as the ultimate beneficial owner of the company.
A Cyprus lawyer was appointed to represent the owner before the Registrar of Cyprus Ships at the Shipping Deputy Ministry (SDM).
2. Provisional Registration (filed within 7 working days)
Provisional registration was selected as a fast-track stage.
The application pack normally includes:

Application letter (Form EN11F20) and owner identification/company documents.

Bill of Sale or Builder’s Certificate, plus a Deletion Certificate from the previous flag (if applicable).

Tonnage measurement carried out by a recognised organisation for the Tonnage Certificate.

Evidence of yacht marking in accordance with Cyprus regulations.

Proof of ownership and encumbrances, insurance cover note, and payment receipts.
Once submitted, the SDM issues a Provisional Certificate of Cyprus Registry, valid for six months (extendable by three).
3. Radio Licences and Identifiers
Before departure, the yacht must obtain the necessary communications licences. This includes applying for a Ship Radio Licence and MMSI number under Cyprus law, covering VHF, AIS, and EPIRB systems.
4. Customs and VAT Positioning
If the yacht already holds EU status through prior VAT payment, proof can be obtained electronically (T2L/T2LF via the PoUS system). This allows the vessel to circulate freely within EU waters without additional import or VAT formalities.
Alternatively, non-EU yachts may use the Temporary Admission regime, which allows up to 18 months of VAT-free cruising in EU waters, subject to stricter conditions.
5. Path to Permanent Registration
During the provisional period, any outstanding class or flag surveys are carried out. Permanent registration must then be completed within six months (or nine if extended), with submission of original documents and confirmation of carving and marking.
6. Optional Parallel and Bareboat Registration
Cyprus law also provides for parallel (bareboat in/out) registration options. These can be used if the yacht is chartered abroad under a temporary foreign flag while still retaining its Cyprus registry connection.
